The court on Monday issued the arrest warrant after the NDC MP Dorcas Toffey’s failed to appear in court in a contempt case against her
A Sekondi High court has rescinded the bench warrant it issued for the arrest of Member of Parliament for Jomoro, Dorcas Toffey.
It comes after the MP appeared in court on Thursday ( 9 December), together with her lawyer Edudzi Tameklo, and Emmanuel Armah-Kofi Buah, MP for Ellembelle.
Lawyer for the MP told Citi News after proceedings that there was no basis for the warrant.
“We moved the court prayerfully to rescind the warrant of arrest. The court graciously acceded to our prayer and the warrant stands rescinded…. In the wisdom of the court, there was no basis to have the warrant still subsisting, and we are grateful to the court.”
“For the substantive application to be moved on the contempt case, we have agreed to come back on 16 February 2022,” he said.
Background
A Sekondi High Court, Commercial Division, presided over by Justice Sedina Agbemava on Monday (6 December) issued a bench warrant for the arrest of Dorcas Toffey, the Member of Parliament (MP) for Jomoro in the Western Region.
The warrant followed her absence from the hearing of a contempt case against her on Monday morning.
The contempt case was filed against her by one Joshua Emuah Kofie from Nuba-Mpataba in the Jomoro Constituency when the MP allegedly failed to appear before the Registrar of the court to produce documents evidencing her renunciation of Ivorian citizenship as ordered by a Sekondi High Court.
In his affidavit in support, the petitioner had noted that on 22 June 2021, a Sekondi High Court ordered the respondent to within 10 days produce for inspection and copying of the renunciation certificate of her Ivorian citizenship or any document evidencing renunciation of her Ivorian citizenship.

Meanwhile, a Sekondi High Court presided over by Justice Dr. Osei-Hwere has set 20 December 2021 to rule on an application filed by the Jomoro MP to make some amendment in her affidavit in the substantive case.
Joshua Emuah Kofie is challenging Dorcas Toffey, to produce evidence of her renounced dual citizenship in court.
According to the applicant, the MP was not qualified to contest as the people’s representative in the country’s legislative assembly.
When the case was called on Monday, the MP was represented by one Emmanuel Venle.
Her counsel, Ebo Donkor, standing in for Edudzi Tamakloe, insisted that the court had the discretion to grant the application, but lawyer for the applicant, Bright Okyere Agyekum prayed the court not to exercise that discretion since pleadings had been closed.
